ActiveVideo Wins $115M Lawsuit over Verizon

A jury in the U.S. District Court for the East District of Virginia has awarded ActiveVideo a $115 million win over Verizon in a patent infringement lawsuit. ActiveVideo has asserted that Verizon infringed on its patents for the delivery of advanced television applications, such as video-on-demand (VOD) and interactive TV.

When ActiveVideo opened the suit in May, 201, alleging infringement on four patents, a Verizon spokesperson replied with, "This is without merit." Verizon later countersued with claims on two patents, an action which was invalidated by the court in May.

ActiveVideo won't be collecting just yet, though, as Verizon has promised to file an appeal, and won't pay until that appeal goes to court. 

"Verizon disagrees with the verdict and is confident that the Court of Appeals will agree," says Ed McFadden, a spokesperson for Verizon.

The verdict followed three weeks of proceedings in the court.

"We're extremely pleased that the judge found that ActiveVideo intellectual property was valid and that the jury found that Verizon infringed on all asserted claims," says Jeff Miller, president and CEO of ActiveVideo Networks.  "We are seeking immediate payment of the damages that have been awarded by the court; in addition, our legal team, Morgan Lewis & Bockius LLP, will be filing an injunction against Verizon to prevent any further unlawful use of our technology."
